Courts of arbitration - Do they protect companies at public expense?

The clauses covering investment protection are some of the most disputed in the TTIP talks. Should investors have the power to take a sovereign state to court, if they feel they've been unfairly treated? Unlike regular court hearings in many countries, those in courts of arbitration are not open to the public, but their rulings are just as binding.
